MINUTES of December 4, 2012 ANC 4A MEETING

Fort Stevens Recreation Center, Van Buren and 13^th Streets, NW, Washington, DC

Roll Call:  Commissioners Bennett, Toliver, Whatley, Wilson, Kennedy, and Black were in attendance.

Approximately 20 people were in attendance from the community.

Having determined that there was a quorum; Commissioner Toliver called the meeting to order at 7:16 PM.

I.      ADMINISTRATIVE ACTIONS

a.     AGENDA.  Commissioner Bennett moved to accept the December 4, 2012 agenda.  Motion seconded by Commissioner Kennedy.  Hearing no objections, the motion was passed unanimously.

b.     MINUTES.  Commissioner Whatley moved the November 2012 minutes be accepted as amended and leaving section III.a.i., concerning “The Little Green Nest” to be covered at a later date.  Motion seconded by Commissioner Black.  Hearing no objections, the motion was passed unanimously.

c.     QUARTERLY REPORT.  Commissioner Whatley reported that as of 9-30-12 the checking account balance was $34,050.72 and the savings account balance was $40,236.14.

                                               i.     Commissioner Black noted an administrative error on the accounts where Commissioner Black’s address appears instead of the ANC office.

                                             ii.     Commissioner Toliver stated that according to district law, the ANC cannot spend money in advance of an obligation.

                                            iii.     Commissioner Whatley moved the September quarterly report be approved as amended.  Motion seconded by Commissioner Wilson. Motion passed 5-1 with Commissioner Black opposed due to incorrect address and name issue on the account.

                                            iv.     Commissioner Whatley moved the budget for fiscal year 2012-2013 be approved.  Motion seconded by Commissioner Wilson.  Motion passed 5-1 with Commissioner Black opposed. 

II.    PRESENTATIONS

a.     Joy Holland.  There are over 100 pieces of legislation going forward today.  Some highlights include:

                                               i.     Ominous Vehicle Act.  This act seeks to lower the fines for speeding and the amounts that had been determined lately by $50-$60.

                                             ii.     Construction & Demolition Waste Recycling Accountability Act will require all individuals to be licensed and certified in this field.

                                            iii.     Motorized Bike Amendment Act will require all motorized vehicles be moved to the street.

                                            iv.     Bad Actor Suspension Act – Contractors that are not doing what they are supposed to do will have their names removed from list of approved vendors after two strikes.

                                             v.     Accessibility Parking Amendment Act.  The installation of red top meters for disabled and seniors is going forward requiring payment by everyone.  Senior and disabled citizens will get twice the time allotted.

                                            vi.     ANC 4A Commissioners were invited to the annual ANC party in the Wilson Building at 6:30pm this Thursday.

                                          vii.     WMATA hearing W6 and W8 bus schedule in Anacostia held yesterday with Councilmember Barry.  WMATA has decided they will not be pulling services in that area.  They need more DC residents on that payroll and installation of operational cameras on ALL buses.

                                         viii.     Bloomingdale and Ledroit Park legislation introduced to reimburse those for flooding.

III.  COMMUNITY CONCERNS

a.     Bulk Trash Issue. – A resident on Underwood was told that it would be two months before they could pick up mattresses in her alley. Commissioner Toliver instructed the resident to send an email of complaint (with a copy to Commissioner Bennett) to Director Bill Holland and Kevin Twine at DPW as they monitor and respond to these types of issues.

IV.  COMMISSIONER DISCUSSIONS/PRESENTATIONS

a.     Commissioner Toliver drafted a letter to the Mayor and prepared a resolution of ANC 4A requesting  the district identify and provide suitable office space or a $600 rent subsidy for its office space within the ANC 4A boundary.   Commissioner Whatley moved the resolution be approved as amended.  Seconded by commissioner Wilson.  All in favor.  Motion passed unanimously.

b.     The Little Green Nest BZA Application Update.  Commissioner Toliver moved that Commissioner Bennett contact the applicant (The Little Green Nest) to ascertain what changes are being made to the application and report back to the commission.  Motion seconded by Commissioner Kennedy.  Motion passed 5-1 with Commissioner Whatley opposed.

                                               i.     Patience Singleton (Tuckerman resident) complained of insufficient notice of the BZA hearing by The Little Green Nest and that their representation lied about her at the hearing.

                                             ii.     Gerri Adams-Simmons (Tuckerman resident) further complained that The Little Green Nest did not provide the legally required notice of the hearing either by contacting neighbors or posting a sign on the property.

Meeting adjourned at 9:18 PM. 

Commissioner Black moved to adjourn the meeting.  Commissioner Wilson seconded the motion.
